Notification
The Ortho Phosphoric Acid (Quality Control) Order, 2021 was first notified via S.O. 2335(E) dated 15th June 2021, mandating BIS certification for Ortho Phosphoric Acid under IS 798:2020. The commencement date was shifted from 15th December 2021 to 10th June 2022 through S.O. 4914(E) dated 29th November 2021, and further extended to 10th December 2022 by S.O. 2225(E) dated 13th May 2022. Subsequent amendments included S.O. 1709(E) dated 13th April 2024, which granted a 90-day exemption for Ortho Phosphoric Acid used as raw material in fertilizers, and S.O. 2975(E) dated 26th July 2024, which made this fertilizer exemption permanent.
Overview
Ortho Phosphoric Acid is a critical industrial chemical used in fertilizers, food processing, pharmaceuticals, and multiple downstream industries. The mandatory certification under IS 798:2020 ensures that the product supplied in the domestic market meets quality, purity, and safety requirements, thereby protecting consumers and industrial users.
Objective & Scope
The standard aims to regulate the quality of Ortho Phosphoric Acid by mandating conformity with IS 798:2020 and licensing under BIS. It covers all domestic manufacture, import, storage, and sale of the chemical, ensuring consistency in product quality while supporting India’s industrial and agricultural value chains
Products Covered
The Order specifically applies to Ortho Phosphoric Acid as listed in the QCO table, intended for all non-exempt industrial and commercial applications in India.
Exemptions Provided
Goods manufactured exclusively for export are exempt. In addition, Ortho Phosphoric Acid used as raw material for the production of fertilizers is permanently exempt under S.O. 2975(E) of 26th July 2024, following an earlier temporary exemption in April 2024.
Industries Impacted
The regulation directly impacts manufacturers and importers of Ortho Phosphoric Acid, distributors and traders, and downstream industries such as food, beverages, pharmaceuticals, and electronics chemicals, except where the fertilizer exemption applies. Testing laboratories and supply-chain operators handling the product are also affected.
Mandatory Compliance Requirements
All covered Ortho Phosphoric Acid must conform to IS 798:2020, obtain a BIS licence under Scheme-II of the BIS (Conformity Assessment) Regulations, 2018, and bear the BIS Standard Mark on packaging and documentation.
Enforcement Timeline
Originally notified in June 2021, enforcement was deferred twice, with the final effective date set at 10th December 2022. The fertilizer exemption was made permanent in July 2024.
Legal Provisions, Enforcement & Penalties
The BIS Act, 2016 and BIS (Conformity Assessment) Regulations, 2018 provide the legal basis for enforcement. The Bureau of Indian Standards is the certifying authority, with powers to seize non-conforming goods, suspend licences, and impose penalties including fines and imprisonment for violations.
Conclusion
Since 10th December 2022, Ortho Phosphoric Acid supplied in India for non-exempt purposes must comply with IS 798:2020 and carry the BIS Standard Mark under licence. Export consignments and fertilizer raw-material use are excluded, while all other industrial applications remain subject to strict BIS oversight to ensure quality, safety, and reliability.
