Notification
The Agro Textiles (Quality Control) Order, 2023 was notified by the Ministry of Textiles through S.O. 4248(E) dated 27 September 2023 under the BIS Act, 2016. It mandates BIS certification for a set of agro-textile products, including Insect Nets conforming to IS 16513:2016. The enforcement date, originally 1 April 2024, was extended to 1 July 2024 by Amendment Order S.O. 1579(E), dated 28 March 2024.
Overview
This Order makes it compulsory for manufacturers and importers of insect nets to obtain BIS certification before they can market their products in India. The move aims to improve product reliability and protect agricultural productivity by ensuring conformity to national standards.
Objective & Scope
The key objective is to regulate the quality of insect nets used in agriculture and horticulture by enforcing conformity to IS 16513:2016. These nets play a vital role in protecting crops and plants from insect pests, thereby reducing the dependency on chemical pesticides and promoting safer agricultural practices. The Order applies to both domestically produced and imported products sold in India.
Products Covered
All the Insect Nets that conform to IS 16513:2016 are covered. These are typically woven or knitted agro-textile nets made from materials like polyethylene or polypropylene, used as physical barriers to protect crops in open fields, greenhouses, and nurseries.
Exemptions Provided
Goods meant exclusively for export are exempt from the requirements of this Order.
Industries Impacted
- Agriculture – Widely used in vegetable cultivation, floriculture, and open-field farming to protect crops from insect damage.
- Horticulture – Essential in greenhouses, nurseries, and orchards to ensure healthy plant growth and reduced pest infestation.
Mandatory Compliance Requirements
All insect nets covered under this notification must conform to IS 16513:2016. They must be certified by the Bureau of Indian Standards (BIS) and carry the Standard Mark (ISI mark). Certification must be obtained under Scheme-I of the BIS (Conformity Assessment) Regulations, 2018. Products without this certification cannot be manufactured, sold, imported, or distributed in India after the enforcement date.
Next Steps for Stakeholders
- Manufacturers and Importers should apply for BIS certification immediately to meet the 1 July 2024 deadline.
- Product testing must be conducted at BIS-recognized laboratories.
- Packaging and labeling must be updated to include the ISI mark and licensing details.
- Distributors and traders should verify compliance documents from suppliers post-enforcement.
Legal Provisions, Enforcement & Penalties
This QCO is enforceable under the provisions of the BIS Act, 2016. The Bureau of Indian Standards (BIS) is the designated authority for certification and enforcement. BIS has the power to conduct inspections, seize non-compliant products, suspend or cancel licenses, and initiate legal prosecution. Non-compliance may result in fines, product seizure, or imprisonment, as per Section 29 of the BIS Act.
Conclusion
From 1 July 2024, it will be mandatory for all insect nets sold in India to comply with IS 16513:2016 and be certified by BIS. This regulation is crucial for safeguarding crop health, reducing pesticide use, and maintaining national quality benchmarks. Timely compliance is essential for uninterrupted market access and regulatory assurance.
