Legal Compliance Snapshot

If you are manufacturing, importing, or selling injection moulding machines or other plastics/rubber processing machinery, your equipment is now under mandatory BIS certification as per the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024, issued via S.O. 3649(E) and amended by S.O. 2579(E).

Compliance Deadline: 1 September 2026
Under Sections 16, 17, and 25 of the BIS Act, 2016, uncertified machines post-deadline will be barred from Indian markets and may face seizure, prosecution, and criminal penalties.

What the Law Requires

All machines under HS Code 8477 (rubber and plastics processing, especially injection moulding) must:

  • Obtain a valid BIS license and affix the ISI Mark
Undergo certification under Scheme X, which involves:
    • Factory audit
    • BIS-recognized lab testing
    • Submission of a technical file (design, hazard analysis, safety specs)
    • Labeling, operator instructions, and conformity markings
  • Conform to IS/ISO 20430:2020, which sets out detailed safety requirements for injection moulding machines

Consequences of Non-Compliance

  • Seizure of machines
  • Ban on import or sale in India
  • License cancellation
  • Monetary fines
  • Criminal prosecution (up to 2 years imprisonment under Section 29 of BIS Act, 2016)

Steps to Legalize Your Machinery

  1. Identify applicable Indian Standard (IS/ISO 20430:2020 or others if applicable)
  2. Register with BIS via ManakOnline Portal
  3. Prepare technical documents including safety file and risk assessment
  4. Submit machine samples for BIS lab testing
  5. Undergo a factory audit under Scheme X
  6. Apply ISI marking and ensure labeling as per BIS norms

Conclusion Over :-Why Action is Urgent ?

Non-compliance is not just a commercial risk — it is a statutory offence. After 1 September 2026, uncertified machines cannot legally be imported, sold, or distributed in India. BIS is already ramping up inspections and enforcement under the Omnibus Order.

Complying now offers the following benefits:

  • Full statutory protection
  • Access to public tenders and exports
  • Insurance and safety reputation assurance
  • Avoidance of costly legal violations
