Notification
Electric stoves are included in the Electrical Wires, Cables, Appliances and Protection Devices and Accessories (Quality Control) Order, 2003, notified by S.O. 189(E) on 17 February 2003. The QCO was subsequently amended by S.O. 165(E) (5 Feb 2004), S.O. 1172(E) (22 Aug 2005), S.O. 512(E) (19 Feb 2009), S.O. 2058(E) (7 Aug 2009) and S.O. 2604(E) (19 Oct 2010), the latter modifying the proviso language on exemptions.
Enforcement Timeline
The Order took effect on 17 February 2003; from that date manufacture, import, storage, distribution or sale of electric stoves in India requires BIS certification and ISI marking unless an export exemption applies.
Overview
IS 302 (Part 2/Sec 202):1992 sets the particular safety and test requirements for electrically heated stoves (open heating elements). It addresses construction, insulation, temperature limits, stability, protection against electric shock, and test procedures to ensure safe operation in household environments.
Objective & Scope
To protect users from risks of electric shock, burns and fire by prescribing mandatory safety design features and test requirements for electric stoves intended for general domestic and similar use.
Products Covered
Electrically heated stoves with open-type heating elements intended for connection to supplies up to 250 V AC single-phase (and specified DC applications), including portable/table-top electric stoves used in households and small commercial settings.
Exemptions Provided
Export-only consignments may be exempt per the QCO proviso subject to Government approval and conditions; there is no general domestic exemption for non-ISI electric stoves. The 2010 amendment (S.O. 2604(E)) altered proviso wording.
Industries Impacted
Manufacturers of electric stoves, heating element/OEM suppliers, importers/distributors, retailers, e-commerce platforms, hospitality product suppliers and accredited testing/certification laboratories.
Mandatory Compliance Requirements
BIS Standard-Mark (Scheme-I) product certification is mandatory. Products must pass type/routine/acceptance tests in BIS-recognised labs per the Product Manual (PM/IS 302-2-202), undergo factory inspection and carry the ISI mark and licence details on the product and packaging before domestic sale.
Next Steps for Stakeholders
Apply for BIS Standard-Mark licence under Scheme-I; follow the Product Manual PM/IS 302-2-202 (Jan 2024) for test methods and documentation; commission tests in BIS-recognised labs; set up routine QA and marking traceability; update procurement and tender documents to require ISI-marked stoves.
Legal Provisions, Enforcement & Penalties
The Order is enforced under the BIS Act, 2016. Contraventions (e.g., manufacture/sale of non-conforming or non-marked goods) attract actions including search/seizure and prosecution. Section 29(3) prescribes penalties up to two years’ imprisonment and fines (with specified minimums and escalation for repeat offences).Â
Conclusion
Electric stoves under IS 302 (Pt 2/Sec 202) have been in the mandatory BIS regime since 17 February 2003 and require BIS certification, PM-specified testing and ISI marking for domestic manufacture, import and sale. Compliance preserves user safety and avoids enforcement action.
